1. Overview
These Terms & Conditions ("Terms") govern your access to and use of the Beverly Volunteer Fire Department "BVFD," "we," "us," or "our") website at www.beverlyvfd42.com, related communications, and any services, donations, registrations, ticketing, fundraising activities, or other features offered through or linked from this website (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and by any additional rules posted for a particular fundraiser, raffle, event, registration, ticket, donation campaign, or other activity. If you do not agree, do not use the Service or complete the applicable transaction.
2. Definitions
• Beverly Volunteer Fire Department / BVFD / we / us / our means the fire department or nonprofit organization identified above.
• User / you / your means any person accessing the Service or completing a transaction.
• Service means this website, related communications, and any online feature or third-party service made available through or linked from the website.
• Campaign means any donation drive, fundraiser, raffle, drawing, event, ticketed activity, registration, merchandise offering, or similar public activity.
3. Use of the Website
This website is provided for informational, community engagement, emergency-preparedness, public communication, and fundraising awareness purposes. You may not misuse the Service, attempt unauthorized access, interfere with operation or security, submit malicious material, impersonate another person, or use the Service in violation of law.
Emergency communications: This website is not an emergency reporting system and is not monitored for emergency dispatch. In an emergency, call 911 or the appropriate local emergency number.
4. Accuracy, Availability, and Department Information
Information is provided in good faith for general public use. We try to keep content current, but announcements, schedules, event details, apparatus information, eligibility requirements, policies, pricing, and operational notices may change. We do not guarantee that the Service will always be uninterrupted, error-free, or available.
5. Fundraisers, Raffles, Events, and Public Activities
BVFD may promote or conduct donations, fundraisers, raffles, drawings, ticketed events, registrations, merchandise sales, or community activities. Participation is voluntary and is subject to applicable federal, state, and local law, any required permits or licenses, and the official rules posted for that activity.
Eligibility, age, residency, prize restrictions, drawing procedures, ticket limits, fulfillment terms, transfer rules, and refund eligibility may vary by campaign. Where campaign-specific rules conflict with these general Terms, the more specific lawful campaign rules control for that campaign.
6. Stripe and Other Payment Processor Restrictions
BVFD may use third-party payment processors such as Stripe to accept lawful donations or payments. Stripe and other processors maintain prohibited and restricted business categories that may limit or require prior approval for particular items, services, fundraising models, sweepstakes, contests, raffles, games of chance, or other activities.

BVFD will comply with applicable processor restrictions and may modify, suspend, cancel, or move an offering to another lawful payment method if a processor does not support the activity. The presence of Stripe or any other payment option on the website does not mean that Stripe or that processor sponsors, administers, endorses, controls, or approves the underlying fundraiser, raffle, prize, event, or program.
Charitable raffles, sweepstakes, and similar fundraising activities must not be processed through Stripe unless the department’s specific use is supported and, where required, expressly approved by Stripe. Processor approval is separate from state or local licensing and legal requirements.
7. Payments, Donations, and Transaction Processing
Payments, donations, registrations, ticket purchases, or other transactions may be processed through third-party services. BVFD does not store full payment-card numbers or card security codes when those details are entered directly into a hosted or embedded third-party payment interface. The payment processor’s own terms and privacy practices apply to its processing of payment information.
Transaction records may include the purchaser or donor name, contact information, billing information, amount, date, campaign, transaction identifier, payment status, and other information reasonably needed for receipts, fulfillment, fraud prevention, reconciliation, accounting, legal compliance, and customer support.
BVFD is not responsible for outages, authorization declines, processor holds, bank delays, or technical errors caused solely by a third-party provider, but we will make reasonable efforts to help resolve transaction questions within our control.
8. Refunds, Cancellations, and Exchanges
Refund eligibility, if any, is governed by the Refunds & Rules Policy posted on www.beverlyvfd42.com, the specific campaign or event rules, applicable law, and any mandatory payment-processor or card-network requirements. Unless otherwise stated, completed donations and campaign purchases may be final and processing or service fees may be non-refundable to the extent permitted by law.
If an event is canceled, rescheduled, or materially changed, the department will communicate the remedy, if any, through the applicable event or campaign information. Nothing in these Terms limits rights that cannot lawfully be waived.
9. Tickets, Entry, and Event Conduct
An event ticket or registration may constitute a limited, revocable license to attend the applicable event subject to posted rules, venue capacity, safety requirements, and lawful instructions of event staff. Tickets may be denied, canceled, or revoked for fraud, duplication, prohibited resale, rule violations, safety concerns, or other lawful reasons.
The purchaser is responsible for safeguarding tickets, confirmation emails, QR codes, or credentials. The department may require identification or proof of eligibility where reasonably necessary for age, residency, prize, registration, or ticket verification.
10. Disputes and Chargebacks
If you believe a transaction is incorrect, duplicated, unauthorized, or not fulfilled as described, please contact BVFD promptly at beverlyfiredepartment42@gmail.com or 304-636-5032 so we can investigate and, when appropriate, issue a correction or refund. We may contest chargebacks or payment disputes that we believe are inaccurate, fraudulent, duplicative, or inconsistent with the transaction records and applicable campaign rules.
Nothing in these Terms waives a consumer’s rights under applicable law or card-network rules, and you should not seek or receive both a direct refund and a separate chargeback for the same amount.
11. Third-Party Services and Links
The Service may link to or use third-party websites and services, including payment processors, ticketing providers, maps, social networks, analytics providers, email or SMS providers, cloud services, and other vendors. Those services are governed by their own terms and privacy policies. BVFD is not responsible for third-party content, availability, privacy practices, or policy changes.
12. Intellectual Property
Unless otherwise stated, department logos, text, photographs, graphics, website design elements, and other department-created content are owned by Beverly Volunteer Fire Department or used with permission. Unauthorized copying, resale, commercial exploitation, or misleading use is prohibited. Third-party marks remain the property of their respective owners.
13. Disclaimer and Limitation of Liability
To the fullest extent permitted by law, the Service is provided on an "as available" basis without warranties that cannot be implied from the circumstances. BVFD and its officers, members, volunteers, employees, and representatives are not liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website,
third-party services, or participation in an activity, except where liability cannot lawfully be excluded.
Event attendance and participation may involve ordinary risks associated with public gatherings, travel, weather, parking, physical activity, or venue conditions. Campaign-specific waivers or safety terms may apply when lawfully posted and accepted.
14. Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims caused by your unlawful misuse of the Service, fraud, infringement of another person’s rights, or violation of these Terms. This section does not require you to indemnify the department for the department’s own unlawful conduct.
15. Governing Law
These Terms are governed by the laws of the State of West Virigina, without regard to conflict-of-law principles, except where federal law controls or applicable law requires otherwise. Any venue or dispute-resolution clause should be reviewed by local counsel before publication.
16. Changes to These Terms
BVFD may update or revise these Terms from time to time. Changes become effective when posted unless another effective date is stated. Material changes affecting an active campaign may also be communicated through the relevant campaign page or other reasonable notice.

Refunds & Rules Policy

This policy provides the general refund, ticket, fundraiser, donation, raffle, and event rules for Beverly Volunteer Fire Department "BVFD," "we," "us," or "our"). Campaign-specific rules may add lawful requirements or more specific terms.
1. General Rules
• Participation in any department fundraiser, event, raffle, drawing, registration, ticketed activity, donation campaign, merchandise offering, or public program may be subject to specific posted rules.
• Eligibility, age requirements, residency requirements, prize restrictions, ticket limits, participation restrictions, and payment-processor requirements may vary by activity and applicable law.
• BVFD may update schedules, availability, prize details, participation terms, or campaign details when reasonably necessary and permitted by law.
• Participants are responsible for reviewing the applicable event or campaign details before completing a purchase or donation.
2. General Refund Policy
• Unless otherwise stated for a specific event, campaign, registration, raffle, drawing, ticket, merchandise purchase, or fundraiser, completed payments may be considered final to the extent permitted by law.
• Refunds may be issued when required by law, when the department approves an exception, or when the applicable event or campaign rules expressly provide for a refund or credit.
• Third-party processing fees, service charges, platform fees, delivery fees, or transaction fees may be non-refundable unless required by law or stated otherwise.
• Any approved refund will generally be returned to the original payment method when reasonably possible.
3. Donations
Charitable donations are generally final once processed. The department may review requests involving duplicate transactions, incorrect amounts, unauthorized transactions, technical errors, or other exceptional circumstances. Tax-deductibility depends on applicable law and the donor’s individual circumstances; donors should consult their own tax adviser.
If a donor receives goods, services, tickets, chances, entries, or other value in connection with a payment, that transaction may not qualify as a fully deductible charitable contribution. The department should provide any required receipt or disclosure based on the actual transaction.
4. Tickets, Registrations, and Event Admission
A ticket or registration may represent a limited, revocable license to attend the specified event. The department or event operator may refuse or revoke admission for fraud, duplication, prohibited resale, failure to satisfy eligibility requirements, unsafe conduct, or violation of posted event rules, subject to applicable law.
Purchasers are responsible for safeguarding tickets, QR codes, confirmation emails, or other credentials after delivery. Lost, stolen, copied, damaged, or compromised credentials may not be replaceable if the department cannot reasonably verify ownership or prevent duplicate use.
Tickets may not be copied, reproduced, counterfeited, misrepresented, or resold in violation of law or the applicable event rules. The department may void tickets obtained from unauthorized or fraudulent sources.
5. Event Cancellation, Rescheduling, and Material Changes
If an event is canceled, rescheduled, postponed, relocated, or materially changed, the department will determine and communicate the available remedy based on the circumstances, applicable law, contractual obligations, and event-specific rules. Remedies may include a refund, credit, transfer, replacement date, or other lawful option.
A change in weather, performer or speaker lineup, schedule, parking plan, food/vendor availability, or other incidental event feature does not automatically create a refund right unless the event-specific rules or applicable law provide otherwise.
6. Raffles, Drawings, Games of Chance, and Similar Fundraisers
Raffle, drawing, chance, sweepstakes, or similar fundraising purchases are subject to the official campaign rules, applicable licensing requirements, age and residency restrictions, prize restrictions, and all applicable federal, state, and local laws. Once an eligible entry has been issued or entered into a drawing, the purchase may be non-refundable except where required by law or expressly stated in the official rules.
A payment processor must support the specific activity. Stripe currently treats charitable raffles and sweepstakes as restricted activities in supported jurisdictions; BVFD must not use Stripe for such transactions unless its specific use is supported and any required Stripe approval has been obtained. Processor approval does not replace any state or local license or legal requirement.

7. Payment Processor Notice
Payments may be processed by third-party providers such as Stripe or another approved payment processor. These processors provide transaction services; they do not sponsor, administer, endorse, control, select winners for, fulfill prizes for, or operate BVFD fundraisers, raffles, events, prizes, or public programs unless expressly stated otherwise.
BVFD remains responsible for its own campaign rules, customer support, event operations, lawful prize fulfillment, refund decisions within its control, and compliance with applicable law.
8. Processing Errors and Duplicate Charges
If you believe you were charged more than once, charged the wrong amount, charged without authorization, or did not receive the expected confirmation, contact BVFD promptly at beverlyfiredepartment42@gmail.com or 304-636-5032. Please provide the purchaser name, transaction date, amount, and any receipt or confirmation number available. Do not send full card numbers or card security codes by email.
9. Chargebacks and Payment Disputes
We ask purchasers and donors to contact the department first when possible so we can investigate and resolve legitimate transaction concerns. BVFD may contest chargebacks or disputes that it reasonably believes are inaccurate, fraudulent, duplicative, or inconsistent with the transaction records, delivery evidence, and posted campaign rules.
A purchaser should not obtain both a direct refund and a separate bank or card-network recovery for the same transaction. Nothing in this policy restricts rights that cannot lawfully be waived under consumer-protection law, card-network rules, or the purchaser’s agreement with the issuing bank.
10. Entry, Identification, and Venue Rules
The department or event operator may require a valid ticket, confirmation, identification, proof of age, proof of residency, or other eligibility documentation where reasonably necessary. Attendance may also be subject to venue rules, security screening, capacity limits, safety procedures, and lawful instructions of event staff.
To the fullest extent permitted by law, BVFD is not responsible for personal property that is lost, stolen, damaged, or misplaced at an event, or for losses caused solely by third parties outside the department’s reasonable control.
11. Refund Timing
If a refund is approved, the department will submit it to the original payment method or other lawful method as appropriate. Posting time is controlled by the payment processor, card network, bank, or financial institution and may vary. A submitted refund may therefore take additional business days to appear on the purchaser’s statement.
12. Currency and Bank Differences
If a transaction involves currency conversion, foreign exchange differences, bank fees, or card-issuer fees, the amount ultimately credited by the purchaser’s financial institution may differ from the original amount. The department is not responsible for exchange-rate changes or third-party bank fees except where required by law.
13. Changes to This Policy
BVFD may update this Refunds & Rules Policy from time to time. Changes become effective when posted unless another effective date is stated. Changes will not retroactively eliminate rights that have already vested under applicable law or a specific campaign rule.

When card details are entered directly into the processor’s hosted or embedded payment interface, BVFD does not store or collect the full payment-card number or card security code. The processor’s use of payment information is governed by its own privacy policy, security standards, and applicable PCI-DSS obligations.
We may receive limited transaction information from the payment processor, such as the payer’s name and contact details, billing information, payment amount, transaction status, payment method type, and transaction identifier, as needed for receipts, reconciliation, fulfillment, fraud prevention, accounting, refunds, disputes, and legal compliance.
